In a Commercial Trial, a legal entity claimed a significant financial amount from one of Legal & Fixer's clients through a lawsuit for alleged breach of contract.

In defense of our client, Legal & Fixer answered the lawsuit, counterclaimed, and obtained preliminary injunctions, including the freezing of bank accounts of both the plaintiff company and all of its shareholders.

Based on the foregoing, the plaintiff in the lawsuit requested a settlement, whereby they signed an agreement acknowledging that our client had not breached the contract. Consequently, they agreed to pay our client various amounts due to their unlawful actions.

The controversy revolved around the unconstitutionality of a normative portion of a revenue law, where primarily the principle of tax equity, contemplated in the Political Constitution of the United Mexican States, was being violated to the detriment of the client.

Once the constitutional control proceeding was processed, the Federal Judge granted the injunction to our client, ordering the authorities to disincorporate the application of the aforementioned legal provision from their legal sphere.

The representation and filing of a direct amparo lawsuit filed against a final judgment that confirmed a tax credit determined to the detriment of the taxpayer.

A Regional Chamber of the Federal Administrative Justice Court upheld the challenged resolution without conducting a substantive analysis, improperly imposing excessive evidentiary burdens and maintaining criteria that implied double taxation on amounts with a high economic impact.

In light of this, the Legal & Fixer team promoted a direct amparo lawsuit, achieving the Federal Justice system granting constitutional protection in favor of their client, so that the responsible authority would issue a new resolution, fully valuing the evidentiary elements presented since the review stage.

As a result, a new favorable judgment was issued, which nullified the enforceability of specific amounts, freeing the taxpayer from an unnecessary tax burden.

In an Administrative Litigation Trial, Legal & Fixer represented its client due to the authority's omission in granting over 105 transport permits, as a consequence of the validity of concessions in that matter.

The defendant authority had refrained from recognizing the acquired rights of our client, who on multiple occasions requested their realization, without receiving any response.

In the review and audit procedures of a State Government's public accounts in Mexico, the Superior Audit Office of the Federation requested that our client provide information related to Public Contracts entered into with the entity.

For which, Legal & Fixer carried out the defense of the individual, performing an exhaustive analysis of the documentation (contracts, digital tax receipts, receipts, deliverables, orders, reports, accounts, invoices proving ownership, accounting books, and legal instruments) that were related to the provision of services.

The complexity of the matter lay in the comprehensive and interdisciplinary study of legal, tax, and accounting matters involving over 35,000 documents that our client made available to us for analysis. We successfully met the requirements punctually, preventing the legal entity from being sanctioned based on the value of the Contracts, in accordance with the Federal Audit and Accountability Law.
